Nel contesto delle attività di terza missione degli Atenei, ossia di quella che può essere intesa come la “funzione sociale” dell’Università, il presente volume è il frutto del Progetto “I pericoli del gioco d’azzardo nell’era digitale. Strategie di prevenzione e azioni di contrasto”, realizzato nell’anno 2020 dal Gruppo di La- voro sul Gioco d’Azzardo Patologico del CRID – Centro di Ricerca Interdipartimentale su Discriminazione e vulnerabilità dell’Università di Modena e Reggio Emilia (www.crid.unimore.it) in collaborazione con la Fondazione Universitaria “Marco Biagi” di Modena, con il contributo e il patrocinio del Comune di Modena nell’ambito del Progetto Regionale “Legalità e Territorio 2020”. I contributi raccolti offrono un’analisi del fenomeno del gioco d’azzardo patologico nell’epoca digitale e delle insidie che esso pone in particolare alle persone rese vulnerabili. L’intento è quello di suggerire proposte e strategie di prevenzione ad uso di Istituzioni, Enti e Associazioni.

Adottando una chiave di lettura filosofico-giuridica, il volume tratteggia un percorso di analisi che mira a mettere in evidenza le potenzialità e i limiti, le opportunità e i rischi, che la nuova realtà digitale determina nell’attuale sistema di diritto antidiscriminatorio di matrice europea. In particolare, vengono esaminati alcuni profili che ineriscono allo statuto giuridico delle persone, agli assetti della Pubblica Amministrazione, alle trasformazioni in corso nell’attività lavorativa e d’impresa. Infine, mediante un’analisi puntuale delle fonti normative, l’autrice richiama l’esigenza di un “controllo umano significativo” sulle procedure automatizzate, indispensabile per perseguire strategie volte a soddisfare il principio di eguaglianza sostanziale.

This paper analyses Edmund Burke’s view of slavery, focusing in particular on his Sketch of a Negro Code and its legal background. Two forces in tension will be identified: the first one takes imperial economic necessities seriously, within a concept of a legal order based on an “organic” premise; the second one leads to a view of moral equality between human beings that does not exclude black people.

The work of Sarah Moore Grimké (1792-1873) was shaped by a combination of abolitionist and feminist militancy, since she was an agent of the most radical anti-slavery movement as well as author of one of the very first American texts in favor of extending women’s rights, also influencing the Seneca Falls Convention (1848). This entry shows the relevance of her contribution in the history of the philosophy of law.

Considering the whole corpus of Mary Wollstonecraft’s writings, this paper focuses on her view of rights, seen as moral claims and rhetoric tools. Firstly, it is argued that, in the author’s perspective, their technical and judicial dimension is peripheral, where “rights” are human features within a religious conception of life. Secondly, some consequent aspects are analysed, such as the rights’ effectiveness, their nature, their content and their entitlement.

This paper presents some aspects of the legal and philosophical thought of the American jurist Catharine MacKinnon, with a particular focus on her negative anthropology and on the reclaiming power of rights. Specific attention will also be given to her view of equality, which refuses the formal logic of the Aristotelian formula (“treating likes alike and unlikes unalike”) in order to emphasise the substantive elements rooted in the social background. Finally, some critical remarks and conclusive reflections will be presented.

This paper focuses on forced detention, conceived as a constitutive element of trafficking in persons as well as the common denominator between trafficking and slavery. After describing habeas corpus as a normative instrument “within” the State to grant protection against forced capture, the analysis will stress the relevance of international law tools “beyond” the State’s perimeters, such as the recent ICTY jurisprudence.

This paper offers a conceptual clarification of the concept of “vulnerability”, focusing in particular on the legal meanings it has recently assumed. Considering the cultural legacy relative to the act of burial, the reflection will also lead to put at stake, through the vulnerability’s perspective, the need for a harmonization and an updating of the legislation referred to cemeteries and sepulchres.

This paper aims at critically examining the anaytical perspective proposed by a recent work by Daniel O'Neill. In particular, it discusses the convenience of a dichotomous distinction, between "we" and "the others", based on a purely imperialistic logic, in Edmund Burke's writings on slavery.

The volume offers an analysis of the legal and philosophical thought of Edmund Burke (1729-1797), with peculiar reference to his view of equality, opposed to the concept derived from the Enlightenment and embodied in the Déclaration (1789). Burke’s perspective is based, on the one side, on the principle of authority and, on the other side, it aims at understanding the complexity, plurality and “great diversity” which ground the social and institutional order. Through this analysis, the reflection will critically shed a light on the relationships between law and morals, gradualism and perfectibility, change and social conservation, manners and “order” in the work of an author extremely controversial and useful to understand recurring issues in the history of modern and contemporary legal and philosophical thought.

The volume analyses the nexus between education, society and institutions in the work of Mary Wollstonecraft. It also offers a particular focus on some aspects which are relevant from a legal and philosophical perspective, such as: the relationship between rights, freedom and Republicanism; the mutual link between public and private sphere of existence; virtue and civic friendship; law and morals. The arguments emphasise, following Wollstonecraft’s view, the relevance of the equality principle as a foundational criterion for citizenship.

Il diritto antidiscriminatorio affonda le proprie radici nel principio di eguaglianza, postulando la necessità di trattare in modo eguale situazioni eguali e in modo diverso situazioni diverse, a meno che vi sia una valida ragione per non farlo. I principi stabiliti dalle direttive e dai documenti normativi europei hanno recentemente articolato un sistema definitorio e processuale che la produzione scientifica ha contribuito a integrare. In questo contributo, dopo aver trattato degli aspetti fondamentali del diritto antidiscriminatorio all’interno della giurisdizione europea, si rifletterà su due fattispecie illecite che paiono dotate, nella loro configurazione tipica, di una matrice discriminatoria sulla base del sesso: le molestie sessuali e le violenze domestiche. Si procederà poi con un’analisi giurisprudenziale, mediante la quale sarà possibile addurre ulteriori elementi di riflessione. Il discorso approderà infine alla valorizzazione del principio di libertà personale, con particolare riguardo alla sfera più interiore e intima del soggetto: la logica fondativa del diritto antidiscriminatorio infatti pare incompleta là dove non congiunga questo aspetto alla promozione dell’eguaglianza di scopo.

The equality principle is the cornerstone of the western democratic legal orders; still, it is difficult to define it in practical terms. The antidiscrimination law represents an attempt to focus on the substantive dimension of equality, both at a supranational and at a national level, being on of the most relevant questions of our time. Through a legal and philosophical analysis, the volume offers a reflection on some fundamental aspects of antidiscrimination law, with reference to gender issues. In particular, through a specific interpretation of the equality principle and the principle of personal freedom, it aims at understanding the impact of gender discrimination, the strategies of gender mainstreaming and women’s empowerment (set forth by the Conference of Beijing in 1995 and with reference to a “relational” view of autonomy), as well as the transformations produced by new technologies in the relationship between the sexes.

This paper aims at presenting Wollstonecraft’s profile as a translator. Firstly, it will focus on her edited translations (Of the Importance of Religious Opinion. Translated from the French, 1788; Elements of Morality for the Use of Children With an Introductory Adress to Parents. Translated from the German, 1790; Young Grandison. A Series of Letters from Young Persons to Their Friends. Translated with Alterations and Improvements, 1790). Secondly, an overview of her broader tasks as reviewer and reporter will be offered. The analysis will stress the importance of these activities not only in her biography and context, but also in the development of her thought.

This paper focuses on the political, juridical and social impact of education, looking at the English case as a relevant example. A process will be emphasized, gradually removing education from the philantropic and charitable sphere, and giving it new "meanings", such as that of "social duty" and, then, that of a "legal right". During this process, Wollstonecraft's and Mill's approaches are considered as fundamental, with reference also to the gender perspective, in understanding educational development as a necessary element for the human flourishing.

In the International and European context of gender non-discrimination, the framework law 27th June 2014 nr. 6 of Emilia-Romagna Region is the first Italian law which systematically deals with this topic. Meaningful provisions on “traditional” issues connected with gender discrimination are set forth (such as male violence against women and labor issues), as well as “new” provisions on “innovative” matters (from stereotypes to gender medicine). This article describes the framework law contents, considering also some unaddressed issues to be overcome at a national level.

This paper aims at examining the main arguments of the current academic debate on social rights through a comparative reading of five relevant writings. In the first part, the issue of the "foundation" of social rights is analyzed from a theoretical perspective, while, in the second part, reflections are presented on the controversial matter of their "applicability" with particular reference to a context of economic and political crisis. In the third part, new "frontiers" are mentioned, with reference to the European scenario and the multiple levels of the protection of social rights (considered as fundamental rights).

According to Catharine MacKinnon, social reality is characterised by violent and discriminatory practices (as domestic violence) that express the factual hierarchical imbalance between sexes. Based on the practical meaning of the legal concept of “discrimination”, this essay aims at a possible application of MacKinnon’s arguments in the European legal context. Particular attention will be paid to the most recent legislative and case law instruments.
